California Supreme Court Strikes Limits for Medical Marijuana Patients

San Francisco, CA — The California Supreme Court issued a unanimous published decision in People v. Kelly, striking down what it considered unconstitutional legislative limits on how much medical marijuana patients can possess and cultivate.

The decision also affirms protection from arrest and prosecution for patients who both possess a state-issued identification card and comply with state or local personal use guidelines.

“The California Supreme Court did the right thing by abolishing limits on medical marijuana possession and cultivation,” said Joe Elford, Chief Counsel with Americans for Safe Access, the country’s largest medical marijuana advocacy group. “At the same time, the Court may have left too much discretion to law enforcement in deciding what are reasonable amounts of medicine for patients to possess and cultivate.”

Medical cannabis groups present draft policies

The Humboldt County Board of Supervisors seems to be receiving plenty of advice on how medical marijuana should be regulated.The Humboldt Medical Marijuana Advisory Panel (HuMMAP) presented its draft policy — which included graduated licensing fees for cultivation starting at $200 a year for 100 square feet — to the board Tuesday during public comment.

HuMMAP Chair Syreeta Lux said the draft policy is meant to stabilize the county’s economy by increasing county revenues and reducing marijuana-related crime.

She said the policy recognizes “that a greater number of small farmers contributes more to our county’s economy and culture than fewer large growers can.”

Lux said the group hopes that licensing accounts for responsible water use, sustainability and the creation of a certification program. She said HuMMAP hopes the board will take this to the state level to encourage more statewide policy and awareness.

HuMMAP formed after the county’s first open meeting on the marijuana industry and its effect on the local economy held in March.

Another group, the Humboldt Growers Association (HGA), is also providing county officials with input in another way. The group is presenting its draft policy during a nonpublic ordinance workshop today.

The workshop is sponsored by 4th District Supervisor Bonnie Neely and the HGA, which includes at least one of Neely’s campaign contributors. HGA said 3rd District Supervisor Mark Lovelace and Humboldt County District Attorney Paul Gallegos will also be in attendance.

Max Del Real — a medical cannabis lobbyist from the Sacramento-based California Capitol Solutions — who represents the HGA said HuMMAP’s approach is “short-sighted.”

”If HuMMAP is interested in selling out Humboldt’s future, they’re doing the right things,” Del Real said.

He said HuMMAP’s draft policy will allow in big commercial farmers from outside of Humboldt. The draft policy’s licensing fee goes up to $300,000 for 40,000-square feet.

Del Real said HGA is not releasing its draft policy until today but said it focuses on sustainability, job creation and a focus on localization.

While some HuMMAP members have concern over the HGA’s exclusiveness, Del Real said HGA is looking forward to working with HuMMAP.

Lovelace said he welcomes both policies, since the county can use all the help it can get in creating a legitimate marijuana industry. He said he found that HuMMAP’s approach was focused on encouraging smaller businesses — something he agrees with — but there is more work to be done.

He said he was glad that HuMMAP suggested bringing the policy to the state level.

”We’d all like to have some authority at the local level,” Lovelace said about counties in California. “But I think we’d like to have a baseline which we can work with.”

Ingesting cannabis:
Ingesting cannabis has many benefits over smoking it, the most important of which is the bypass of dangerous chemicals entering the respiratory system. Carcinogens and tars are largely left behind in the preparation for eating and are not released into the lungs. Also, ingesting it leads to a markedly different experience from smoking. Eating cannabis-infused preparations usually leads to a longer, stronger, and much more physical high than smoking alone. Although eating is a perfectly viable way of absorbing cannabis into the bloodstream, higher amounts of the drug must be used in a cooking preparation in order to make the product effective.

Smoking delivers more THC to your neuron’s synapse quicker, via direct contact to your lungs alveoli therefore blocking dopamine quicker. Ingesting it causes the THC to be put into the bloodstream via digestion, therefore delivering smaller doses in a longer span of time. That’s why smoking it lasts 1-2 hours but eating it can last up to 8.

In conclusion, ingesting cannabis is a different and healthier alternative for those who use it for medicinal purposes. Once again, the versatility of the cannabis plant will always show its true colors.

Possible Side Effects of Cannabis
There are some effects of cannabis that are not beneficial and can be diminished through awareness.
Cannabis may cause dizziness while standing due to lowered blood pressure.
Initial increase in heart rate / blood pressure may be problematic for those with heart conditions or severe anxiety.
Cannabis may cause a decrease in coordination and cognition.
Potential short term memory loss while medicated.
There are no significant withdrawal effects when cannabis medicine is decreased or stopped. However symptom relief will also be reduced or stopped.
Effects vary from person to person.

Safe Use of Cannabis
Do not drive or operate heavy machinery if impaired by cannabis. Indicas can be especially sedating.
Cannabis mixed with alcohol may cause vomiting and nausea.
Those receiving digitalis or other cardiac medications should only use cannabis under careful medical supervision.
Heavy smoking with no harm reduction techniques may lead to respiratory irritation.
If you share joints or other inhaling devices please hold them so lips do not touch the vessel of delivery.
Beware of mold and fungi.
It is illegal in the United States to possess cultivate or distribute medicinal cannabis under federal law.
Choose organic cannabis whenever possible, especially for those with compromised immune systems.

Knowing Your Medication
Sativa
plants have less chlorophyll than the Indica counterpart. It has a higher THC content to Cannabidiol (CBD) ratio and offers a much more energetic type of mood. Sativa is used most commonly to elevate a depressed mood. Generally speaking the Sativa plant is the taller and lankier variety, reaching heights of over 5-6 meters. It is characterized by narrow serrated leaves and loose spear like flower clusters that can be extremely resinous.

Primarily the effects of Sativas are on the mind and emotions. In this regard they tend to be more stimulating, uplifting, energizing, and creativity enhancing. These benefits can be particularly helpful for the psychological component of many illnesses. Sativas are generally better for daytime use.

Energizes and stimulates
Reduces awareness of pain
Increases focus and creativity
Reduces nausea
Stimulates appetite

Indica has a higher CBD content to THC ratio and induces a more relaxing mood. This is a treatment for anxiety, pain, tremors and many more applications. Indica is most commonly used to induce appetite. Indica plants are normally shorter and stockier plants, reaching 1-2 meters in height and have wide deeply serrated leaves and a compact and dense flower cluster.

The effects of Indicas are predominantly physical although the relief of certain physical symptoms can have an emotional result as well. These effects can be characterized as relaxing, sedating and pain reducing. Indicas are generally best for later in the day or before bed.
